1. Acceptance of Terms
By accessing or using Vendaras (“Platform,” “we,” “our,” or “us”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree, you may not use the Platform.
Vendaras is an online marketplace that allows users (“Sellers”) to list and sell items at discounted prices, and users (“Buyers”) to browse and purchase those items.
2. Eligibility
- To use Vendaras, you must:
- Be at least 18 years old
- Provide accurate and complete account information
- Comply with all applicable laws and regulations
- We reserve the right to suspend or terminate accounts that violate these Terms.
3. Account Responsibilities
You are responsible for:
- Maintaining the confidentiality of your account
- All activity under your account
- Providing accurate and truthful information
- Vendaras is not liable for unauthorized account access resulting from your failure to secure your credentials.
4. Marketplace Role
Vendaras is a platform only. We do not:
- Own or inspect items listed for sale
- Guarantee product quality, authenticity, or legality
- Act as a party in transactions between Buyers and Sellers
- All transactions are conducted directly between users.
5. Seller Terms
By listing items on Vendaras, you agree that:
- Items must be accurately described and truthfully represented
- You must disclose condition clearly (e.g., new, used, defects)
- Pricing should reflect a discount from retail value
- You are responsible for fulfilling orders promptly
You may not list:
- Counterfeit or replica items
- Stolen goods
- Illegal or prohibited items
- Misleading or deceptive listings
- Vendaras reserves the right to remove listings that violate these rules.
6. Buyer Terms
By purchasing on Vendaras, you agree:
- To review listings carefully before purchase
- That items are sold by independent sellers
- To contact sellers directly for questions before buying
Buyer Protection
All sales are final unless:
- The item is not as described, or
- The item arrives damaged
- Refund requests must be submitted within 2 days of delivery and may require supporting evidence (photos, description, etc.).
7. Payments & Fees
- Buyers agree to pay the listed price plus any applicable taxes and shipping
- Sellers agree to applicable platform fees (if any)
- Payments are processed through third-party payment providers
- Vendaras is not responsible for payment processing errors caused by third-party services.
8. Shipping & Fulfillment
Sellers are responsible for:
- Shipping items within stated handling time
- Providing accurate shipping details
- Ensuring items are packaged securely
- Vendaras is not responsible for delays, lost packages, or carrier issues.
9. Returns & Refunds
Each Seller may define their own shop policies, but must adhere to Vendaras minimum standards:
- Refunds only for items not as described or damaged
- Buyers must provide proof when requested
- Vendaras may step in to resolve disputes at its discretion
10. Prohibited Conduct
You agree not to:
- Use the platform for fraudulent activity
- Manipulate listings or pricing deceptively
- Harass or abuse other users
- Attempt to bypass platform fees or systems
- Upload harmful code or interfere with platform functionality
11. Intellectual Property
All content on Vendaras, including logos, branding, and site design, is the property of Vendaras and may not be used without permission.
Users retain rights to content they upload but grant Vendaras a license to display and use it for platform operations and marketing.
12. Termination
We reserve the right to:
- Suspend or terminate accounts at any time
- Remove or suspend listings without notice
- Refuse service for violations of these Terms
13. Disclaimers
Vendaras is provided “as is” and “as available.”
We do not guarantee:
- Continuous or error-free service
- Accuracy of listings
- That transactions will be completed successfully
14. Limitation of Liability
To the fullest extent permitted by law, Vendaras is not liable for:
- Indirect or consequential damages
- Loss of profits, data, or business
- Disputes between Buyers and Sellers
15. Indemnification
You agree to indemnify and hold harmless Vendaras from any claims, damages, or legal disputes arising from your use of the platform.
16. Changes to Terms
We may update these Terms at any time. Continued use of the Platform constitutes acceptance of the updated Terms.
17. Governing Law
These Terms are governed by the laws of the State of Arizona, without regard to conflict of law principles.
